These Terms apply to the User's use of AI-powered features and tools, including "AI Tools," within MiriCanvas, and are in addition to the MiriCanvas Terms of Use and License Agreement. These terms and conditions may be modified by the Company at any time.

Article 1: Purpose

Various AI technology-based functions are in widespread use in various industrial fields and, in particular, have the potential to be utilized as content creation tools by various individuals, such as content creators and artists.

Such potential of AI technology can deliver large-scale benefits in social terms but, at the same time, there are concerns that it may exceed its technological limits or ethical considerations, etc. and be misused.

The Company is endeavoring to create a trustworthy environment so that the Users of MiriCanvas may turn their creative ideas into designs that are legally and ethically safe and use the same.

Therefore, the Company has prescribed its ethical and technological policy for the provision of AI-based products within MiriCanvas, and the use of their output, as follows.

Article 2: Definition of Terms

• AI Tools: AI-powered features and tools which the Company provides

• User Input Data: any text the User enters into an AI tool to generate AI outputs, such as images or other content the User uploads.

• AI Outputs: images or other outputs generated by AI based on User's input.

• Technology partners: partners/individuals who provide the Company with technology and related licenses to provide AI features.

Article 3: Restrictions on Use

As a user of MiriCanvas who uses AI-powered features, including any "AI Tools" provided by the Company, the User agrees that the User will not use any output created by the AI features for the purposes set forth below. If the User breaches these Terms, the User will be obligated to delete the AI Outputs at the Company's request, and the Company may take action to terminate the User's use of the AI Services.

1. The User will not violate or infringe any laws or regulations, including copyright laws, trademark laws, or other laws, or the rights of privacy, likeness, or publicity, in the course of using AI outputs derived from using the AI Tool features.

2. The User shall not be use the AI-based functions for the purpose of exploiting minors, etc.
3. The User shall not be use the AI-based functions to produce content that contains false information in order to harm another person (for the purpose of infringing on another person’s rights).
4. The User shall not be use the AI-based functions for the purpose of damaging another person’s reputation or to insult or slander another person.
5. The User shall not be use the AI-based functions for the purpose of affecting an individual’s legal rights in an adverse manner or to impose a legally binding obligation.
6. The User shall not be use the AI-based functions on/offline in a way that can discriminate against, or harm, the characteristics or behavior patterns of an individual or group.
7. The User shall not be use the AI-based functions for a purpose that can, by exploiting the vulnerability of an individual or group resulting from their age, or social, physical, or mental characteristics, etc., inflict physical or mental harm on that other person or group.
8. The User shall not be use the AI-based functions for the purpose of discriminating against a characteristic of an individual or group that is protected by law.
9. The User shall not be use the AI-based functions for the purpose of presenting medical advice or offering an interpretation of a medical outcome.
10. The User shall not be use the AI-based functions for the purpose of producing an image, document, etc. which is such that an individual who uses it as a form of document with a legal effect can commit a crime.
11. The User shall not be use the AI-based functions in the creation of spam, ransomware, keylogger, virus, or other software.

12. Do not use AI tools to create nudity or stimulating content that includes obscene behavior, bodily fluids, or other profane subjects.

13. Do not use AI tools to generate content that is unethical or otherwise offensive.

Article 4: Liability and Obligations

1. The Company shall not be liable for any legal disputes that have arisen as a result of the use, by the User, of the AI Output for a purpose specified in Article 3 of these terms and conditions.
2. The User is responsible for reading and complying with our AI Tool Features Terms and Conditions, including any applicable policies, in using any text you enter or images or other content the User upload to the Company's AI Tool Features ("User Input Data") and any output generated based on such content ("AI Output"), and the User is solely responsible for any factual or legal liability arising from the User's failure to do so. It is the User's responsibility to ensure that the User comply with the Company's AI Output Usage Policy.
3. The User agrees not to enter any personal information, including data about the User's race, national or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health data, sex life or sexual orientation, in any User Input Data entered when using the AI Tool.

4. The User retains copyright and ownership rights, to the extent permitted by law, in the User Input Data and AI Outputs. The User authorizes the Company to use the User Input Data and AI Outputs for marketing purposes and to improve our Service. Please note that the attribution of rights to AI Outputs may change due to the enactment or amendment of applicable laws and regulations and will vary depending on the laws of your local jurisdiction.

5. The Company do not claim any moral rights in the User Input Data entered by the User or the AI Outputs obtained by the User through the AI Tools.
6. If the User agrees to these terms and conditions and agrees that he or she has full responsibility for the use of the AI Output, the AI Output may be used freely subject to the restrictions under Article 3.
7. If any User Input Data entered by the User or AI outputs obtained by the User through the AI Tools is alleged to be illegal or in violation of these Terms, the Company may disclose it to law enforcement or other government agencies.
8. The User will not represent AI outputs as if they were created by the User. If an AI Result could be mistaken for a human-created work, the User must indicate that it was generated by AI and the User is responsible for any legal liability arising from its use.

Article 5: Sharing and Posting

The User may use AI outputs for personal and commercial purposes to the extent permitted by these Terms. However, the Company will not be liable for any damages the User suffers as a result of the User’s breach of these Terms for AI output used for commercial purposes. If the Company receives a claim from a third party as a result, the User will indemnify the Company at the User’s own expense and risk.

The use and publication of User Input Data and AI outputs entered by the User into AI tools in social media or other works (e.g., publications, print-outs, etc.) is subject to the following conditions.

1. The User shall review the AI Output that is about to be shared or streamed, or has been posted, to check whether it breaches these terms and conditions.
2. Content containing the AI Output shall be marked with the User’s name, or the name of the company, etc. with which the User is affiliated, to indicate its source.

3. The content is clearly labeled as AI-generated by the User viewing the share or post. If AI was used in part, the role AI played must be made clear in a way that is easy to understand.

4. No post or content containing the AI Output shall breach these terms and conditions or offend another person.

5. Do not represent AI output generated by an AI tool as if it was completely and independently created by the User.

Article 6: Exemption from Liability

AI outputs are generated by artificial intelligence, and we do not guarantee the accuracy or representativeness of AI outputs.

1. The Company provides no assurance or guarantee whatsoever regarding the accuracy, completeness, or credibility of the AI Output.
2. The Company shall have no liability whatsoever for any dispute or harm that arises as a result of the User’s use of the AI Output.
3. The Company shall not be liable for any omission or error included in the AI Output.

4. The User will indemnify the Comapny, at the User's own expense and risk, in the event that the Company receives a claim of infringement from a third party due to an AI Output that the User created using the AI Tools.

In order to create more reliable content, the Company encourage the User to carefully review AI outputs before relying on their accuracy.

Article 7: Technology Partner

The Company does not use User Input Data for AI training purposes.
By using Stable Diffusion AI technology to provide AI-powered features, including AI tools, Members agree to be bound by the terms of the Stable Diffusion AI Technology License (Creative ML OpenRAIL-M).

The Company uses technology provided by the Company's technology partners to provide some of the Company's AI products. The User consent to all inputs within the AI tool inputs being shared with the Company's technology partners, such as OpenAI, LLC. This is so that the Company's technology partners can provide their services to the User, and also so that the Company's technology partners can use User Input Data to improve their services. In using the AI tool features provided by the Company's technology partners, the User agrees that the User Input Data shared with the Company's technology partners will include personal information, such as personal data entered by the User, and that such data, such as personal data, will be applied and processed in accordance with the Company's Privacy Policy. The User consents to the transfer of any personal data contained in User Input Data to OpenAI, LLC in the United States. The User's country of residence may not provide the same level of personal data protection. When using features provided by the Company's technology partners, the Company may stop providing some features of the AI Tools if the normal provision of services is difficult due to reasons on the part of the technology partner.
